Please read these terms carefully. They explain the rules for using PakWork as a client or a freelancer, how payments and fees work, and what we can and cannot be responsible for.
1. About these terms
These Terms & Conditions ("Terms") form an agreement between you and PakWork ("PakWork", "we", "us"), the operator of www.pakwork.pk. By creating an account, or by using the website in any way, you confirm that you have read and accepted these Terms, our Privacy Policy and our Cookie Policy. If you do not agree, please do not use PakWork.
These Terms are an electronic contract, which is valid under the Electronic Transactions Ordinance, 2002 and the Contract Act, 1872. Clicking "Create Free Account" or using the website counts as your acceptance.
PakWork is an online marketplace that helps clients in Pakistan find freelancers for small online jobs. We provide the platform. We are not an employer, agency or party to the contract between a client and a freelancer.
2. Who can use PakWork
- You must be at least 18 years old (the age of majority in Pakistan), live in or work from Pakistan, and be able to enter into a binding contract.
- You must give true, accurate and current information and keep it up to date.
- You may have only one account. You are responsible for everything done through your account and for keeping your password secret. Tell us at once at info@pakwork.pk if you think someone else has used it.
- Each person may use their own real name. You may not open an account on someone else's behalf or with someone else's CNIC, phone number or payment account.
- You must confirm your email address before you can post jobs or apply for them. Admins may turn on two-factor login to protect their accounts.
3. Accounts: clients and freelancers
Clients post jobs, review applications, choose a freelancer, pay through the PakWork payment steps and approve finished work. Freelancers create a profile, apply for jobs, deliver the agreed work and receive payment. One person may act as both.
Profiles, job posts, applications and messages must be honest. Do not claim skills, results, reviews or verifications you do not have.
4. Jobs, applications and the agreement between users
- A client who accepts an application creates a direct agreement with that freelancer for the price, delivery time and description shown on the job and application.
- Clients must describe the work clearly and fairly. Freelancers must deliver original work that matches the description, on time.
- PakWork does not guarantee that any job will be filled, that any work will be delivered, or that any work will meet a client's expectations. We do not supervise the work or check its quality.
- We may review, edit, refuse, hide or remove any job, application, profile or message at our discretion, for example if it breaks these Terms or looks unsafe.
5. Payments, fees and payouts
All amounts on PakWork are in Pakistani rupees (PKR / Rs). In this first version of PakWork, payments are handled manually to protect both sides:
- After a freelancer is chosen, the client pays the agreed amount to PakWork by one of the methods shown on the payment page (for example JazzCash, Easypaisa, Raast or bank transfer) and enters the transaction ID, optionally with a receipt image.
- A PakWork administrator checks that the payment arrived. Only then is the job marked as paid and the freelancer may start.
- When the freelancer delivers, the client reviews the work and approves it, or raises a problem.
- After approval, PakWork pays the freelancer the agreed amount minus our service fee of 5%.
- The fee is shown to you before you commit. We may change the fee for future jobs after giving notice on the website.
- Each transaction ID can be used only once. Submitting a false, copied, altered or already-used transaction ID or receipt is fraud and will lead to account removal and may be reported to the authorities.
- Payment provider charges and bank charges (for example JazzCash, Easypaisa or bank transfer fees) are your own responsibility.
- We may delay or hold a payout while we check a payment, a dispute or a report, or if we suspect fraud or a breach of these Terms.
- Never pay or receive money outside PakWork for a job found here. Doing so removes our ability to help you and may lead to suspension.
6. Refunds, cancellations and disputes
- If a client has paid and the freelancer does not deliver, or delivers work that clearly does not match the agreed description, the client may ask for a refund by reporting the job to us at info@pakwork.pk or through the report button.
- We will look at the job description, the messages, the delivered files and any other evidence, and may ask both sides for more information. We may decide to release the payment, refund the client in full or in part, or split the amount fairly. Our decision is final within the platform, but it does not remove your legal rights.
- Once a client has approved the work, the payment is released to the freelancer and cannot normally be refunded.
- Refunds are made to the original payment method or account where possible and may take several working days. Our service fee is not refundable on work that was completed and approved.
7. Taxes
- Freelancers are responsible for their own taxes under the Income Tax Ordinance, 2001 and any other law that applies to them, for example registering for an NTN, filing returns and paying advance tax where required. PakWork does not give tax advice and does not file taxes for you.
- Clients who are businesses are responsible for any tax they must deduct or pay on their own payments.
- Where the law requires PakWork to collect, withhold or report tax, for example sales tax on our service fee or withholding on payments, we will do so and show it to you. Amounts shown to you at the time of the payment are the amounts that apply.
- We may share payment records with the Federal Board of Revenue (FBR), the State Bank of Pakistan (SBP) or another authority when the law requires.
8. Fraud and money laundering
PakWork must not be used to launder money, finance crime or move funds that come from crime. We may ask you to confirm your identity (for example with a CNIC) and to explain the source of a payment. We may refuse, hold or reverse a payment, close an account and report suspicious activity to the authorities, as allowed or required by laws such as the Anti-Money Laundering Act, 2010, the Prevention of Electronic Crimes Act, 2016 and the Payment Systems and Electronic Fund Transfers Act, 2007. We do not "tip off" a person where the law forbids it.
9. Rules of conduct
You agree not to:
- share phone numbers, emails, social media handles or chat links in jobs, applications or messages to take a deal off PakWork, or ask anyone to pay or be paid outside PakWork;
- ask anyone for a joining fee, deposit, advance payment or any money "to get work", or run investment, crypto, forex, "click and earn" or similar schemes;
- ask for or collect passwords, OTP codes, CNIC photos, card numbers or other sensitive details;
- post anything illegal, fraudulent, misleading, hateful, harassing, threatening, sexual or violent, or that infringes someone else's rights;
- request or offer work that is illegal or against Pakistani law, such as fake documents, exam cheating, hacking, spam, fake reviews or impersonation;
- create fake accounts, manipulate ratings or reviews, scrape the website, probe it for weaknesses, overload it, or try to get around our security or safety filters;
- upload malicious files or content that you do not have the right to share.
You must also follow the laws of Pakistan, including the Prevention of Electronic Crimes Act, 2016 (PECA). Among other things, you must not post or send content that:
- is against the glory of Islam, or insults or hurts religious feelings or the beliefs of others;
- threatens the integrity, security or defence of Pakistan or public order, or promotes hatred, sectarian or ethnic violence;
- is obscene, indecent or sexually explicit, or harms the dignity or modesty of a person, or involves a child in any way;
- is false information meant to cause fear, panic or harm, or that spreads lies about a person, or is cyber-stalking, harassment, blackmail or impersonation;
- gains unauthorised access to a system or data, steals identity information or spreads malware.
We remove such content and may give the information we hold to the authorities when lawfully asked.
Our automatic filters and the report button help keep PakWork safe, but they are not perfect. Always follow the advice on our Safety page.
10. Your content and intellectual property
- You own the content you create and upload. You give PakWork a non-exclusive, worldwide, royalty-free licence to host, display and use your profile, job posts and reviews to run and promote the platform.
- Unless the client and freelancer agree otherwise in writing, ownership of delivered work passes to the client once the freelancer has been paid in full. Freelancers may keep the right to show the work in a portfolio unless the client asks for confidentiality.
- You promise that you have the right to share your content and to deliver the work you offer, and that it does not copy or infringe anyone else's rights.
- Your work must not infringe copyright or trademarks protected under the Copyright Ordinance, 1962 or the Trade Marks Ordinance, 2001. We may remove content after a valid complaint and close the accounts of repeat infringers.
- The PakWork name, logo, design, text and software belong to us or our licensors. You may not copy or reuse them without our written permission.
11. Suspension and ending your account
You may stop using PakWork at any time and may ask us to close your account by emailing info@pakwork.pk. Open jobs and payments must be finished or settled first.
We may warn, limit, suspend or permanently remove an account, and cancel or hide content, if we reasonably believe that these Terms have been broken, that someone may be harmed, that fraud is involved, or that we must do so by law. Where it is safe and lawful we will tell you why. Money that is properly due to you will still be paid, less any amount owed because of fraud, refunds or chargebacks.
12. Disclaimers
PakWork is provided "as is" and "as available". We work to keep it secure and running but we do not promise it will always be available, error-free or free of harmful content. We do not guarantee the identity, skills, honesty or reliability of any user, even where a profile shows a "verified" badge, which only means a specific check (such as email) was completed.
You are responsible for deciding whether to hire, work for or trust another user. Use your own judgement and our safety guidance.
13. Limitation of liability
Nothing in these Terms limits a right you have under the consumer protection laws that apply in your province or in Islamabad, or any liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence. Subject to that, and to the extent the law allows:
- PakWork is not liable for the actions, work, content, payments or failures of any client or freelancer, or for disputes between them;
- we are not liable for indirect or consequential loss, loss of profit, income, business, data or goodwill; and
- our total liability to you for any claim connected with PakWork will not be more than the service fees you paid us in the 12 months before the claim arose (or Rs 5,000 if you paid none).
14. Indemnity
You agree to compensate PakWork for loss, claims and reasonable costs that come from your breach of these Terms, your content, or your dealings with other users, to the extent allowed by law.
15. Privacy and cookies
How we collect and use personal information is explained in our Privacy Policy, and how we use cookies in our Cookie Policy.
16. Changes to PakWork and to these Terms
We may update the website, its features and these Terms from time to time, for example when we add online payments. We will change the "Last updated" date above and, for important changes, show a notice on the website or email you. If you keep using PakWork after a change takes effect, you accept the new Terms. If you do not agree, you must stop using PakWork.
17. Governing law, disputes and contact
These Terms are governed by the laws of the Islamic Republic of Pakistan. Please contact us first at info@pakwork.pk so we can try to settle any problem fairly and quickly. If we cannot agree, the courts of Pakistan will have jurisdiction. Consumers may also use the consumer protection courts and councils of their province, and a user who has been the victim of a cyber crime may complain to the cybercrime authorities of Pakistan (the National Cyber Crime Investigation Agency, formerly the FIA Cyber Crime Wing).
If any part of these Terms is found to be unenforceable, the rest stays in force. If we do not enforce a right straight away, we have not given it up. You may not transfer your account or rights to anyone else. These Terms are written in English; if we provide an Urdu or other translation, the English text applies if the two differ.
